Ob der Informationsaustausch zwischen Unternehmen wettbewerbswidrig ist, hängt von diversen Faktoren ab. Mit der „Art der ausgetauschten Information“ und der „Organisation des Informationsaustauschs“ werden in diesem Arbeitspapier zwei Faktoren für Kartellfälle in der EU im Zeitraum 2001 bis 2015 analysiert. Es zeigt sich, dass es sich bei den untersuchten Kartellfällen ausschließlich um „Hardcore-Kartelle“ handelt, die oft durch Bonusanträge der beteiligten Unternehmen aufgedeckt werden. Bezüglich der Organisation des Informationsaustauschs kann konstatiert werden, dass ein regelmäßiger und mehrmals im Jahr stattfindender Informationsaustausch in den untersuchten Kartellfällen dominiert. Zudem präferieren die beteiligten Personen, die auf allen Führungsebenen in den jeweiligen Unternehmen tätig sind, für ihre Kommunikation persönliche Treffen an öffentlichen Orten.

Abstract: 

Whether the exchange of information between companies is anticompetitive depends on various factors. In this working paper, the factors “type of information” and “organisation of information exchange” are analysed for the EU antitrust cases in the period 2001 to 2015. The conclusion which can be drawn is that the investigated cartel cases are exclusively “hardcore cartels” which are often detected with the help of leniency applications filed by companies involved. In the cartel cases investigated above, the information exchange itself takes place on a regular basis several times a year. Furthermore, the involved individuals, who operate at all management levels, use meetings in person at public places as a preferred method to communicate with each other.
